1. Who these terms are between
MPoker is operated by MPoker ("we", "us", "our"). MPoker is a pre-release project: the operating entity is in the process of being incorporated, so no legal form, registered address or company registration number applies yet. When incorporation completes we will reissue these terms under a new version identifier naming the entity, its legal form and its registered address. "You" means the person taking part in the MPoker closed beta.
Contact for these terms, for account recovery and for anything else in this document: support@mpoker.io.
By creating an account you accept these terms and the Privacy Notice identified to you at registration. If you do not accept them, do not create an account.
2. What the closed beta is
MPoker is an online poker platform played with play money only. This is a closed, invitation-only pre-release test whose purpose is to let a small group of invited testers find defects.
- Invitation-only. You need an invitation and a beta access code we issue.
- Ten testers. Self-registration is capped at 10 accounts in total. When the tenth account exists, registration closes automatically and further attempts are refused.
- Free of charge. You pay nothing. There is nothing to buy, no cashier, no deposit, no withdrawal, no payment provider, and no price anywhere in the product.
- Experimental. Features may be incomplete, may behave incorrectly, may change without notice, and may be withdrawn.
3. Play money only
Chips, balances, MGold, rakeback figures, commission figures and every other number shown in MPoker are play money used to operate the game. They have no monetary value, they are not property, they are not a claim, and they are not a debt owed to you.
There are no deposits, no withdrawals, no purchases, no cash or other prizes, and no conversion of chips or any other in-product value into money or into anything else of value.
You must not, and must not attempt to:
- buy, sell, trade, transfer, gift, auction or lend chips or accounts for money or for anything of value;
- redeem, withdraw, cash out or convert chips into money, cryptocurrency, vouchers, goods, services or any other benefit;
- use MPoker to settle, record, track or facilitate a real-money game, wager, stake, bet, debt or backing arrangement, inside or outside the platform;
- take part in any arrangement in which chips stand in for value, including staking, chip dumping for value, make-up arrangements, agent or club settlement in real money, or side payments between players;
- describe MPoker publicly as offering real-money play.
Breaking this section will normally result in immediate and permanent removal from the beta.
4. Eligibility
You may take part only if you received an invitation and a valid access code directly from us, you are at least 18 years old, your use of a play-money poker product is lawful where you are, and we have not previously removed you.
We do not verify your identity or your age; we rely on the confirmation you give at registration. If it is untrue we may close your account.
5. Your account and your credentials
Your account is a username and a password. You may also add one email address in Account security and turn on two-factor sign-in with an authenticator app. Both are optional. We do not ask for your telephone number, real name, date of birth or any identity document, and there is nowhere in the product to supply them.
- You are responsible for your password, your authenticator app and your recovery codes. Do not share them, do not reuse your password from another service, and do not let anyone else use your account.
- Forgotten password. If you have confirmed an email address, you can reset your password yourself with a one-time code we email to it. A reset signs out every device and does not turn two-factor sign-in off. Without a confirmed address, the only route is to contact us at the address in section 1. An operator must satisfy themselves that you are the account holder before setting a new password, and may refuse if they cannot.
- Lost authenticator.
- Each recovery code signs you in once. While you still have a signed-in session, or at least two unused codes, you can turn two-factor sign-in off yourself with one of them and set it up again on a new phone.
- With only one code left and no session, or none at all, contact us. An operator removes two-factor sign-in only after verifying you, and may refuse if they cannot.
- Tell us promptly if you think someone else has used your account.
Your account is personal to you and may not be transferred, sold, lent or shared. Your access code is confidential: do not publish it or pass it to anyone we have not invited. We may change or withdraw the code, and may close registration, at any time and without notice.
6. How you must behave
You must not:
- cheat, collude, soft-play, chip-dump or coordinate play against the table;
- use more than one account, or play two accounts at the same table;
- use a bot, script, solver, real-time assistance tool or any software that plays, advises on or reacts to a live hand for you;
- scrape or systematically extract data from the service, or connect with a client other than the one we publish;
- probe, load-test, reverse engineer, decompile or interfere with the service or its security controls, except where that restriction is void under mandatory law;
- try to obtain information you are not entitled to, including another player's hidden cards, another player's history, or server internals;
- exploit a defect instead of reporting it — if you find a bug affecting chips, cards or permissions, tell us and stop using it;
- abuse, harass, threaten, defame or discriminate against anyone in chat, in a club name, in a message of the day, or in any other text field;
- enter unlawful content or content that infringes someone else's rights.
Table chat is visible to everyone at the table. Treat it as public.
7. The server decides the game
Game rules, dealing, hand evaluation, pot construction, rake and every chip movement are determined by our server. The client on your device only displays what the server sends and forwards your actions. Where client and server disagree, the server's record is authoritative.
We keep a record of completed hands so that disputes can be resolved and chip integrity audited. It contains what happened at the table — who acted, in what order, for how much, the public board, the pots, the results and the rake — together with the cards that became public in that hand — those shown at showdown, and those revealed when an all-in hand was run out. Cards you folded or mucked without ever revealing them are not stored. Access to a hand record is restricted: ordinarily you can see hands you played in, club owners and managers can see their club's hands, and a limited agent-hierarchy scope applies inside a club.
We may correct, reverse or void chips, hands or results that arose from a defect, a rule violation or an operational error. Because this is play money, a correction is not a financial loss to you.
8. Clubs, tables and text you enter
Clubs, tables, aliases, invitation messages, messages of the day and chat are created by users, not by us. If you create or manage a club you are responsible for the text you enter and for how you run it, and you must not use it to organise anything prohibited by section 3.
You keep whatever rights you already have in that text, and you grant us a non-exclusive, worldwide, royalty-free licence to store, display and process it in order to operate, moderate, support and audit the beta. We may remove any content and close any club at any time. We do not monitor content proactively.
9. Your data may be lost
This is the most important operational limitation of the beta, and you should read it before you register.
- Beta accounts and play-money history may be lost. The beta runs on a single server. There is no off-server backup or point-in-time recovery in place during this bounded beta. If that server is lost, your account, your chips and your hand history are lost with it, and we cannot restore them.
- We may reset, adjust or delete play-money balances, clubs, tables and histories at any time, including a full reset before any wider release.
- Nothing you accumulate in the beta is durable, and nothing carries over to any later version by right.
The beta is provided on an "as available" basis. Expect downtime, maintenance, defects and forced updates. You may have to install an update before you can continue playing; if you decline, the client may refuse to connect.
10. Ending your access, and ending the beta
We may suspend or close your account, withdraw your access code, restrict your club or halt a table at any time, with or without notice, including where we believe you have broken these terms or where we suspect a security or integrity problem.
You may stop at any time. There is no self-service account deletion in this build; ask us at the address in section 1 and we will disable the account. What can and cannot then be deleted is described in the Privacy Notice.
We may end the beta as a whole at any time. When it ends, access ends.
11. Software and licence
We or our licensors own the MPoker software, its name, its look, its graphics and its content. We grant you a personal, revocable, non-transferable, non-sublicensable licence to install and use the MPoker mobile client on a device you control, solely to take part in the beta. You may not copy, modify, distribute, sell, sublicense or create derivative works from it, except where mandatory law permits. Third-party components in the app remain subject to their own licences, which are reproduced with the app.
12. Feedback
If you send us feedback, a bug report or a suggestion, we may use it without restriction and without owing you anything for it. Do not send us anything you consider confidential or that you are not free to give us.
13. Warranties and liability
To the fullest extent permitted by law the beta is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We do not warrant that defects will be corrected or that play-money balances or records will be preserved.
To the fullest extent permitted by law we are not liable for indirect or consequential loss, loss of profits, loss of opportunity, loss of play-money balances, or loss of data arising from your use of the beta.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for damage caused intentionally, or for any other liability that cannot lawfully be excluded or limited. Nothing in these terms removes any right you have under mandatory consumer-protection law where you live. Because the beta is free and uses play money only, no monetary liability cap is stated.
14. Personal data
How we handle personal data is described in the Privacy Notice identified to you at registration and published at https://mpoker.io/legal/beta-privacy-1.1. The Privacy Notice is not part of these terms and does not vary them.
15. Changes to these terms
Each published version of these terms carries its own permanent version identifier. When you register, the identifier of the version you accepted is recorded, and that record is not afterwards altered. If we issue a materially different version during the beta we will ask you to accept the new version before you continue, or we will end your access. We will not silently rewrite a version you already accepted.
16. Law, disputes and miscellaneous
These interim beta terms do not impose a choice of governing law or an exclusive forum on you. Mandatory law of your own country of residence continues to apply, including your right to bring proceedings where that law allows.
If a provision is held unenforceable the rest continues in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor of the business on notice. These terms, together with the beta access we grant you, are the entire agreement about the beta and replace any earlier statement about it.
